These Terms of Service (“Terms”) govern your access to and use of Searchly (“Searchly”, “we”, “us”, or “our”), available at trysearchly.com and its subdomains (the “Service”). Please read them carefully.
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. Searchly is an independent service operated from Poland.
Searchly helps you monitor and analyze how AI search engines and assistants describe your brand, and optionally connects to third-party tools such as Google Analytics and Google Search Console to enrich that analysis. We may add, change, or remove features at any time.
To use Searchly you must be at least 16 years old and able to enter into a binding contract. You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly at piotr@trysearchly.com if you suspect any unauthorized use of your account.
Some features of Searchly require a paid subscription. Payments are processed by Stripe.
If you are a consumer in the EU, you have a statutory right to withdraw from a purchase within 14 days. By choosing to start a paid digital service immediately, you ask us to begin before the withdrawal period ends and acknowledge that your right of withdrawal is lost once the service has been fully performed.
When using Searchly, you agree not to:
The Service integrates with and relies on third-party services, including Google (Analytics and Search Console), Stripe, and the AI search engines whose outputs we measure. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them. When you connect a Google integration, you must comply with Google's applicable terms. The prompts you configure are sent to third-party AI engines to produce your results.
You retain ownership of the data you submit to Searchly, including the brands, prompts, settings, and any connected account data. You grant us a worldwide, non-exclusive license to host, process, and use that data solely to provide and improve the Service. You represent that you have the necessary rights to provide this data and to authorize the integrations you connect.
Searchly, including its software, design, branding, and content (excluding your data), is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to access and use the Service in accordance with these Terms. These Terms do not grant you any right to use our name, logo, or trademarks without our prior written permission.
Searchly surfaces and analyzes outputs generated by third-party AI engines. These outputs can be inaccurate, incomplete, biased, or out of date, and may change over time. The Service is provided for informational purposes only and does not constitute professional, legal, financial, or marketing advice. You are responsible for independently verifying results before relying on them.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will meet your expectations. Nothing in these Terms excludes any warranty or right that cannot be excluded under applicable law.
To the maximum extent permitted by law, Searchly will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including your mandatory rights as a consumer.
You agree to indemnify and hold Searchly harmless from any claims, damages, and expenses arising out of your misuse of the Service, your violation of these Terms, or your infringement of the rights of any third party.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if necessary to protect the Service or other users. On termination, your right to use the Service ends and we will delete or anonymize your data as described in our Privacy Policy, subject to any legal retention requirements.
We may modify the Service or these Terms from time to time. When we make material changes to these Terms, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after the changes take effect means you accept the revised Terms.
These Terms are governed by the laws of Poland, without regard to its conflict-of-laws rules, and the courts of Poland have jurisdiction over any disputes. If you are a consumer resident in the EU, you also benefit from any mandatory protections of the law of your country of residence and may bring proceedings there. The European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.
